Co E, 45th Miss Regt; Loring's Brig; became ill within a few days in army and sent to hospital. After recovery was detailed by Drs. Barnett and Dupree and served under them as a nurse until army fell back to Atlanta; rejoined and was captured at Jonesboro. Paroled at Memphis at the close of the war, d. Dec. 26, 1910 in Ark where buried.It has been stated, that Marion C. DILL dies in Arkansas, in 1910, this researcher is wondering at the age of 65, why he went to Arkansas? Is this the same person in above entry? It also appears that Marion C. DILL must have gotten out of jail in 1880 to be shown on the 1880 census with his family. ddt/lgwth Excerpt from the notes of Mike MILLIORN, 1998 Marion indicted for the murder of a negro, Reuben Johnson who was testifying against Marion's brother William for stealing wheat. This became known as the mountain creek mystery in Dallas, County. Arrests were made of Elija T. Rice and William Bell in January of 1875. Marion Dill was also arrested and jailed for the murder. The Dill's maneuverings with lawyers to secure bond for their release resulted in Marion Josephine Dill losing her properties. Marion DilL was sentenced to be " hung by the neck until dead." William Bell was acquitted and Rice got life in prison. Marion Dill and Elija Rice appealed the case to the Supreme Court and were acquitted at one time. Sometime later the case was reopened and Marion Dill was arrested again. Finally, the case was thrown out of court because William Bell who testified in the case originally had skipped the country with his wife. The case drug on in the Dallas courts from January 1875 to January 1881 when for lack of witnesses, Marion Dill was released. It appears that Marion Dill was in the Dallas County jail for most of this time. In January 1888, William Bell reappeared and was arrested and tried for the murder, himself. He was again acquitted, however. It is firmly believed, after examining testimony on record, that Elija T. Rice, who was mentally ill, committed this murder. Later, he and his brother John Dill were accused of murdering their younger brother, Watson. Watson was beaten to death with a club. His body was not found for about a week. John Anderton testified that John Dill promised him a bale of cotton for his help in the murder. Tracks at the murder scene were determined to be that of a woman and a man and not two men. Therefore, it was assumed that Nancy Anderton was John Anderton's accomplice. Watson Dill’s pocket book was found in Nancy's hat box. Mike MILLIORN states John was incarcerated in Huntsville with no mention of Rusk. “Is this the same man?” Further research is needed. lgwth. Expert from Texas Hand book Online: The main building of the present Rusk State Hospital was built in 1878. The Penitentiary was receiving prisoners by January 1883 from the Texas State Penitentiary at Huntsville, TX. These prisoners were used as convict labor for the iron industry in the area at that time Excerpt from the notes of Mike MILLIORN, 1998 No record of marriage or death. When he was 46, he was sentenced to life at the Huntsville penitentiary for the death of his younger brother, Watson in Jack County, Texas. He entered Huntsville on Jan 14, 1895 and was pardoned by Texas Governor, T. W. Campbell on Dec. 23, 1910 after serving almost sixteen years. He was an old man of 62 when he was released, two days before his brother Marion's death. It is believed that John Anderton?, an accomplice made a death bed confession that he killed Watson resulting in John Dill being paroled. Excerpt from the notes of Mike MILLIORN, 1998 Spent time in Huntsville for stealing wheat. Imprisoned June 19, 1876. Sentenced for 2 years for stealing the wheat. Also sentenced to 10 years for robbery Dallas, County. He was a crook through and through, and pulled his brother Marion into trouble in Dallas, County which resulted in the murder of a Negro named Reuben Johnson on Dec. 27, 1874. After being released from prison, he married Lottie Carpenter, a child bride, in Jack County on April 18, 1891. He was sued for sexual abuse after being married two days. My Grand Mother Malissia Josephine Butler-Muse visited her (Wm. B.’s wife) “Aunt Sallie” in Vernon, TX many times. She was very fond of “Aunt Sallie” her name was spoke of by my grandmother, as if she were the blood relative rather than an inlaw. These visits probably corresponded with visits to her Mother Malissia Elsa Lucilla Ann Dill-Dalton-Butler, who lived in Vernon, TX. Malissia Josephine Butler-Muse lived in Altus, Ok at the time, 40 miles away. lgwth.
